What is Mediation?

Mediation is an Alternative Dispute Resolution (ADR) process of solving problems. Usually, the goal of mediation is to keep issues out of court. Mediation is not therapy.

Who is a mediator? Mediators are often, but not always, lawyers. Mediators for divorces must be certified and be a Registered Domestic Relations Mediator with the state of Indiana. They are neutral, meaning they do not advocate for either party. Rather, they facilitate the conversation and help the parties come to the best agreement for themselves.

Why mediation? Mediation is mandatory in some instances. Mediation is often ordered by judges even when mediation is not mandatory. Why not go through mediation earlier in the process and save time and money?

What are the benefits of mediation? The goal of mediation is to keep parties out of court. For that reason alone, mediation is more cost-effective than going to trial. In addition, parties can craft their own agreement, as opposed to have a judge issue one. In terms of divorce, this often means that parents can consider their work schedules, which holidays they prefer, how they want marital property divided, and more. Agreements are submitted to the court and are binding legal documents. Essentially this means that a judge is not making decisions for a family based on general laws, but that the family themselves have come up with what works for them. Mediation lays a foundation for parents to co-parent and make joint decisions as their kids grow older.
